§ 1 Scope of application
For orders via the online store of Jakobsweg [Bewahrer] the General Terms and Conditions apply in the current version. Deviations from these terms and conditions are only effective if they have been confirmed by us in writing.

§ 2 Conclusion of contract
With your order you make a binding offer to us to conclude a contract with you. We can accept this offer by sending you an order confirmation by e-mail or by delivering the ordered goods. First, you will receive a confirmation of receipt of your order by e-mail to the e-mail address you provided (order confirmation). However, a purchase contract is only concluded when our order confirmation is sent to you by e-mail or when the ordered goods are delivered.

§ 3 Retention of title
The delivered goods remain our property until full payment of all claims.

§ 4 Prices and shipping costs
All stated prices are in Euro (EUR) and include the statutory value added tax.

The shipping costs within Germany are per order from € 0.00 to a maximum of € 3.95. From an order total of € 59.00 we ship free of charge in Germany.

The shipping costs to EU countries is € 5,45 per order to non-EU countries € 6,95.

The shipping costs are automatically calculated and displayed during the order process in our online store.
If you enter your address data incorrectly or incompletely and the shipping company commissioned by us can not deliver the goods to you, you have to pay the additional shipping costs.

§ 5 Delivery
Unless otherwise agreed, the goods will be delivered to the delivery address provided by you. You are responsible for the complete and correct address data.
Unless otherwise stated in the products offered, we will ship the goods within 1 to 4 working days after receipt of payment.

§ 6 Terms of payment
We accept payments via PayPal, Amazon Pay or prepayment.

Payment via Paypal
PayPal is an online payment service that allows you to pay in online stores securely, easily and quickly. To use Paypal, you need a Paypal account, where you can store your bank or credit card details, so that they do not have to be re-entered for each purchase. With Paypal you can then pay by entering your email address and password. Your Paypal account will be debited directly with the corresponding amount and you will receive an order confirmation by e-mail. Payment by Amazon Pay
Amazon Pay is an online payment service that allows you to pay in online stores securely, easily and quickly. In order to use Amazon Pay, you need an Amazon account, where you can store your bank or credit card details so that they do not have to be entered again for each purchase. With Amazon Pay, you can then pay by entering your email address and password. Your deposited account will be debited directly with the corresponding amount and you will receive an order confirmation by e-mail. For more information, please refer to the website 'https://pay.amazon.de/'.

Payment in advance
We will send you a confirmation of receipt of your order with details of our bank account by e-mail. Please enter the first and last name of the invoice recipient as the reason for payment so that we can accurately allocate your transfer. After the amount has been credited to our account, the goods will be shipped.
To avoid discrepancies, please make the payment only after receiving the confirmation of receipt. Please transfer the invoice amount within 7 working days.

§ 7 Due date
Payment of the purchase price is due upon conclusion of the contract.

§ 8 Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

by means of a clear declaration (e.g. a letter sent by mail, fax or e-mail) about your decision to revoke this contract. You can use the attached sample withdrawal form for this purpose, which is, however, not mandatory. You can also fill out and submit the model cancellation form or another clear declaration electronically on our website http://www.jakobsweg-bewahrer.de. If you make use of this option, we will send you confirmation of receipt of such revocation without delay (e.g. by e-mail).

To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of the revocation
If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs of returning the goods.

You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

§ 9 Warranty
The warranty period is two years from the date of delivery of the goods.

In the case of complaints, it is necessary that Jakobsweg [Bewahrer] can trace the date of purchase. The claimed item(s) should be sent to Jakobsweg [Bewahrer] together with a copy of the invoice, if available. In the case of a justified complaint, we will refund the cost of the return shipment.

For defects in the delivered goods, the statutory warranty provisions apply.



You are obliged to report obvious defects in the goods, including transport damage, to Jakobsweg [Bewahrer] without delay, but no later than one week after delivery of the goods. If this deadline is missed, warranty claims for defects are excluded.

The warranty does not cover defects due to natural wear and tear, wear and tear due to use or improper use.

§ 10 Data protection
You can visit the web pages of Jakobsweg [Bewahrer] without giving us personal data. When you visit our web pages, the servers we use store by default the IP address currently used by your PC, the date and time, the browser type and the operating system of your PC as well as the pages you have viewed. However, this does not allow us to draw conclusions about personal data, nor is it intended to do so. We only pass on your data to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of the goods. We assure you that we will not otherwise pass on your personal data to third parties unless we are legally obliged to do so or you have given your express prior consent. Insofar as we use the services of third parties for the implementation and handling of processing procedures, the provisions of the Federal Data Protection Act will be complied with.

Duration of storage
Personal data that has been communicated to us via our website will only be stored until the purpose for which it was entrusted to us has been fulfilled. Insofar as retention periods under commercial and tax law must be observed, the duration of storage of certain data may be up to 10 years.

Claims for damages from positive breach of contract, from culpa in contrahendo and from tort are excluded both against Jakobsweg [Bewahrer] and against our vicarious agents, unless the damage was caused intentionally or by gross negligence. The liability of Jakobsweg [Bewahrer] is in any case limited to the respective amount of the order value.

§ 12 Applicable law and place of jurisdiction
German law is exclusively applicable. This choice of law applies to you only insofar as it does not restrict any mandatory statutory provisions of the state in which you have your residence or habitual abode. If you are not a consumer, the agreed place of jurisdiction is Mühlhausen, in 99974 Thuringia.

§ 13 Severability clause
Should any provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions of these General Terms and Conditions shall not be affected. The parties undertake to replace the invalid provision with one that economically corresponds to the purpose of the contract.
